Understanding Rape Charges in Queens & NYC
The degrees of a rape charge can vary according to the severity or particular circumstances surrounding the alleged crime. Under New York law, third-degree rape is a class E felony that is punishable by up to four years, and occurs when a person has sexual intercourse with a victim who will not, or cannot consent, or if the offender is over 21 years old and the victim is less than 17 years old. In the case of second-degree rape, the offender must engage in sexual intercourse with someone who is mentally disabled or incapacitated, or have sexual intercourse with someone age 15 or younger, while being 18 years of age or older.
