Requirements for Eligibility
The SIJ visa is specifically for nonresidents who are unable to live with parents anymore. Applicants cannot yet be adults, and they must already be living in the United States.
In addition, applicants must be:
- Unmarried
- Dependent on the court or in the custody of a state agency or department
- Unable to reunify with parents due to abuse, abandonment, neglect, or some other similar issue
- Put in an unsafe situation were they to return to their country of nationality or the last residence with parents
- Genuinely in need of relief from harm rather than seeking an immigration benefit
- In possession of written consent of the Department of Health and Human Services or Office of Refugee Resettlement saying that you are in their custody and are cleared to change your custody status
Petitioning for SIJ Classification
To obtain a change of status, you will need to submit a few forms and other information.
This includes:
- Form I-360
- Appropriate documents proving the applicant’s age
- Juvenile court order suggesting a change of status
- Written consent from the Department of Health and Human Services
- Form G-28
