LGBT Asylum in New York City & Queens
Protecting the Asylum Rights of LGBT Clients in New York
From legalizing sexual activity between same-sex couples to legalizing gay marriage in 2015, the United States is considered an LGBT-friendly country. Unfortunately, many countries throughout the world are not, subjecting gay, lesbian, bisexual, transgender, or transsexual (LGBT) to mistreatment and/or persecution.
If you are subject to hostility in your native country that places your life in imminent danger, our Queens immigration attorney at Musa-Obregon Law PC is committed to helping you obtain asylum in the U.S. and making it your new home. With more than 100 years of combined experience, our firm possesses a comprehensive understanding of the asylum process to help keep you safe from harm and reasonable fear of harm.
How to Apply for Asylum
LGBT individuals may seek asylum in the U.S. on the basis of being a member of a particular social group. On the application, they must demonstrate a genuine fear of future persecution if they returned to their homeland. Persecution entails various forms of mistreatment, including severe discrimination, violence, threats of harm, torture, harassment by law enforcement, detention, and confinement. You can establish asylum by proving you have been the victim of persecution prior to arriving in the U.S. or you are subject to future persecution.
Eligible individuals must apply for asylum within one year of entering the U.S. If the deadline has passed and there is a risk of deportation, they may apply for asylum and withholding or removal by completing Form I-589. Our Queens immigration lawyer can also help members of the LGBT community obtain permission to work and apply for permanent residency after one year of being granted asylum in the country.
