F1 Visa Attorney NYC

Secure Your F-1 Student Visa in New York City

If you wish to study in the United States, you must first obtain a visa. A visa is a legal document, issued by the government, which allows you to visit, live, work and/or study in the U.S. A student visa is a non-immigrant visa, meaning it allows for a temporary stay in the country. There are two types of student visas: F-1 visas and M-1 visas; most students coming to the U.S. will require F-1 visas.

Applying for an F-1 visa can be difficult, with specific procedures to follow and paperwork that must be filled out and filed in a particular way to give you the best chance of having your application approved in a timely manner. A single mistake could result in a denied visa or unnecessary delays. This is why you may benefit from involving a legal professional to help you apply for a student visa.

At Musa-Obregon Law PC, we represent students from countries across the planet who are seeking F-1 or M-1 visas. With a New York City immigration attorney from our firm to help you file your application and represent you in any resulting hearings or appeals, you can rest easy in knowing your case is in good hands. You can avoid costly errors and protect your ability to study in America.

We represent individuals throughout Queens, Brooklyn, The Bronx, Manhattan, Rockland County and Westchester County.

Step-by-Step Guide to Applying for Your NYC Student Visa

Citizens of foreign countries must obtain visas before coming to study in the United States. A visitor (B) visa may be obtained for a short, recreational course of study, but a special student visa must be obtained for other courses of study and extended stays.

According to the Bureau of Consular Affairs, a division of the U.S. Department of State, an F-1 visa may be obtained if a person wishes to come to the U.S. to attend the following educational programs/facilities:

  • Private elementary school
  • High school
  • College or university
  • Seminary
  • Conservatory

F-1 visas may also be obtained for other academic institutions, including language training programs. For a "vocational or other recognized nonacademic institution," an M-1 visa must be obtained.

To apply for a student visa, you must first apply for and be accepted to attend a Student and Exchange Visitor Program (SEVP) approved school. This is a U.S. school that is authorized to accept students from foreign countries on F-1 or M-1 visas. Once accepted by the school, you will be enrolled in the Student and Exchange Visitor Information System (SEVIS) and will have to pay a fee for this. The school will then provide you with a Form I-90 to present to the U.S. embassy or consulate when you attend your visa interview. Your spouse and/or children may also come to the U.S. with you while you study, but they must obtain visas as well.
